Federal Proposed Legislation

SUMMARY:

The Department of Justice (“Department” or “DOJ”) is amending the regulations of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF”) to clarify when a rifle is designed, made, and intended to be fired from the shoulder. Specifically, under the Gun Control Act of 1968 (“GCA”) and the National Firearms Act of 1934 (“NFA”) the definition of “rifle” shall include a weapon that is equipped with an accessory, component, or other rearward attachment (e.g., a “stabilizing brace”) that provides surface area that allows the weapon to be fired from the shoulder, provided other factors, as described in this preamble and in the amended regulations, indicate that the weapon is designed, made, and intended to be fired from the shoulder.

Effective date: This rule is effective January 31, 2023.

Compliance Date: Any weapons with “stabilizing braces” or similar attachments that constitute rifles under the NFA must be registered no later than May 31, 2023.

Dianne Feinstein (D-Calif.), Richard Blumenthal (D-Conn.) and Chris Murphy (D-Conn.) have introduced their new draconian "assault weapon" ban (AWB), and we need everone to take action to stop it.

  • Bans the sale, manufacture, transfer and importation of 205 "military-style assault weapons" by name. Owners may keep existing weapons.
  • Bans any "assault weapon" with the capacity to utilize a magazine that is not a fixed ammunition magazine and has one or more "military characteristics" including a pistol grip, a forward grip, a barrel shroud, a threaded barrel or a folding or telescoping stock. Owners may keep existing weapons.
  • Bans magazines and other ammunition feeding devices that hold more than 10 rounds of ammunition. Owners may keep existing magazines.
  • Requires a background check on any future sale, trade or gifting of an "assault weapon" covered by the bill.
  • Requires that grandfathered assault weapons are stored using a secure gun storage or safety device like a trigger lock.
  • Prohibits the transfer of magazines holding more than 10 rounds.
  • Bans bump stocks and other devices that impact the rate of fire for semi-automatic rifles.
  • The bill includes a grandfather clause that exempts all weapons lawfully possessed at the date of enactment.

Representative Diana DeGette of Denver Colorado has introduced her new bill, H.R.625 - To regulate large-capacity ammunition feeding devices.

As you can tell from the title, this bill will aim to regulate standard capacity magazines. while the extent of this regulation and ban has yet to be seen, based on her track record and the 94 co-sponsors on the bill, it cannot be good.

Any magazine ban is a direct attack on one of the most common components of the most common firearms in the country, and thus a direct assault on your rights and your ability to exercise them.

This bill is an unacceptable Infringement on your fundamental human rights and MUST be opposed with all the vigor we can muster.

A new bill has been introduced that looks to destroy the barriers that prevent the ATF from explicitly maintaining a searchable digital database.

The Crime Gun Tracing Modernization Act has been introduced by the anti-gun duo of Senator Dianne Feinstein (D-Calif.) and Congressman Bill Pascrell (D-N.J.), and it aims to allow the ATF to maintain a serchable database, under the guise of it being used to track fireams used in crime, but we know different.

Attempted firearm confiscation is not possible without a federal registry, and this is the first step to making that happen.

State Propsed Legislation

Colorado is planning an "assault weapons" ban, and while it has been slightly watered down since its initial leaked draft, it is still a god-awful peice of legislation.

This new AWB only targets the sell or transfer of an "assault weapon", ignoring those who possess these weapons, for now.

We all know it wont stay that way.

We need everyone to demand thier reps not support this bill. It has already been weakened, but make no mistake, this only makes it easier for them to pass.

Maryland is at it again, and this time are trying to ban the carry or transportation of all firearms across the entire state.

SB 1 and SB 118 would collectively ban the carrying, transportation, or possesion of firearms on almost ALL public and private land. These bills would make Maryland the most restricive state in regards to off-limits places, and represent a very real and very urgent danger to the people of Maryland.

HF 14 seeks to implement near- Universal Background Checks (UBCs) at the state level. A disastrous policy, background checks and the NICS system in general have been shown time and time again to be incredibly fallible and prone to errors. This bill would only serve to deprive law-abiding people of their rights and endanger those in need of finding a way to defend themselves

HF 15 would institute "Red Flag Gun Confiscation Orders", allowing the chief law enforcement officer, the chief law enforcement officer's designee, a city or county attorney, any family or household members of the respondent, or a guardian, to petition the court to remove your firearms without any trial, conviction, or due-process. This violates multiple rights, and would certainly be abused by the state or other nefarious actors.

HF 396 would require the "safe storage" of firearms and ammunition, making them all but useless in the event of an emergency and leaving you and your family defenseless at home. This bill would require the firearm to be locked up and stored sperate from ammuntion when not under direct control of the owner or an authorized user. It is none of the State's business where or how you keep your firearms.

And finally, HF 601 would require mandatory reporting, a practice that has been proven totally ineffective at impacting crime committed with firearms in any measurable way by a RAND study. This only serves to victimize the victim of the firearm theft if the firearm isnt reported as they outline. This just gives the State more tools to target gun owners, as the time that the reporting is required is discretionary based on what the State deems "reasonable."

Any one of these bills alone would be severely harmful to gun owners in Minnesota, and the fact that all four could pass with their new trifecta in the state is very troubling.

A slew of gun bills have made their way into the New Mexico legislative calendar this session, and none of them are good news.

Currently, the New Mexico bills introduced so far include:

  • SB 116: Bans the possession and purchase of firearms for anyone under the age of 21
  • HB 101: Bans the possession, sale, manufacture, or transfer of "assault weapons" or standard capacity magazines
  • HB 50: Would ban standard capacity magazines or anyone other than state agents

Washinton is at it again for a 7th time pushing for an "assualt weapon" ban. This bill is copy and paste from almost every other ban, outlawing the sale, manufacturing, and possesion of many of the most common rifle patforms by name, such as most AR-15s, AK-47s, and the like.

This bill is closer than ever to passing, and will only be stopped if EVERYONE contacts their representitives and demand it be opposed!

In addition to this bill, HB 1179 and HB 1195 have been introduced and are a direct assualt on wheree you can carry and gives local municipalities athority to FURTHER restrict gun rights in their jurisdictions.

All three bills are moving to commitee.
